Senator Levin was on the floor speaking about his requests for information from the Bush Administration regarding the treatment of detainees. He said that these requests are relevant seeing as Ms. Fisher was deputy while concerns about interrogation tactics were being raised. He said that instead of respecting the constitutional role the Senate plays in providing advice and consent, the Administration has continually thwarted it by denying the Senate relevant information. He asked if the stonewalling was part of a pattern of secrecy that the Administration has engaged in in various areas. He asked his colleagues to support any Senator who has asked for relevant information before being expected to vote on a nominee.

Senator Cornyn was on the floor and suggested that Ms. Fisher was a qualified nominee who deserves to be confirmed. He said that he was troubled by Senate Democrats whose obstruction has prevented this important national security position from being filled. Senator Cornyn discussed Ms. Fisher's previous experience, beginning with her service as Deputy Special Counsel to the U.S. Senate Special Committee to investigate Whitewater and continuing with her five years of private practice in a Washington, D.C. based law firm.

Senator Leahy was on the floor speaking about the nomination of Alice Fisher to be Assistant Attorney General. He said that despite the Senate is being asked to consider this nomination in two weeks before the election recess despite the fact that numerous questions remain about the nominee. Senator Leahy argued that there are many pressing issues facing the country that need the attention of the Senate, yet they do not share the same sense of urgency as this nomination.

Senator Leahy was on the floor speaking about the ongoing crisis in Darfur. He said that, despite the partial peace agreement signed in May, the three-year civil war has intensified in recent months. He continued to suggest that despite the best efforts and good intentions of the African Union peacekeeping force, it is simply understaffed and unable to stop the violence in Darfur. Senator Leahy said that urgent action is needed to save Darfur and he outlined several steps that must be taken in order to secure a lasting peace. The Senate has reconvened and is now in a period of Morning Business. The first 15 minutes will be under the Minority control and the second 15 minutes will be under Majority control, after which the Senate will move to consideration of H.R. 5684, the United States - Oman Free Trade Agreement Implementation bill. A roll call vote on passage of H.R. 5684 is expected to occur at 12:00 p.m. The Senate will recess from 12:30 2:15 p.m. today for the weekly policy lunches. At 2:15 p.m. the Senate is scheduled to reconvene and move to consideration of Executive Calendar #171, the nomination of Alice S. Fisher of Virginia to be the Assistant Attorney General. Following the use or yielding back of time, there will be a vote on Executive Calendar #171.
